Agreement to these terms

These Terms of Service ("Terms") govern your use of this website and your inquiry into the Wellness Circle LIVE program operated by Motivated and Moving, LLC ("we," "us," "our"). By using this site or submitting a form, you agree to these Terms.

About the program

Wellness Circle LIVE provides live virtual wellness sessions for senior living communities, led by a licensed physical therapist assistant. Sessions include guided group movement, education, and social engagement built on the six dimensions of wellness.

Not physical therapy or medical care

Wellness Circle LIVE is a wellness program. It is not physical therapy, medical treatment, or clinical care. Participation in the program does not create a clinician and patient relationship between any participant and Motivated and Moving, LLC or any of its personnel. The program does not diagnose, treat, or manage any medical condition.

The credential of the program leader is stated as a fact about who leads the program. Residents and communities should consult qualified healthcare providers for medical advice, diagnosis, or treatment, and before beginning any new movement or exercise activity.

Community responsibilities

Participating communities are responsible for:

  • Determining which residents are appropriate to participate, in consultation with residents' own healthcare providers where applicable
  • Providing a safe physical space, supervision, and equipment appropriate to their residents
  • Ensuring residents participate at their own comfort level and stop any activity that causes pain or discomfort

Scheduling and services

Session frequency, scheduling, and fees are agreed between Motivated and Moving, LLC and each community through a separate service arrangement discussed on the discovery call. Nothing on this website constitutes a binding offer of services.

Communications

By submitting our interest form and checking the required consent box, you agree to receive calls, emails, and text messages from Motivated and Moving LLC about your inquiry and scheduling. Message and data rates may apply. You can reply STOP at any time to opt out of text messages. Optional program updates are sent only if you check the separate program updates box.

Intellectual property

All content on this website, including text, graphics, logos, and session materials, is the property of Motivated and Moving, LLC or its licensors and may not be reproduced without permission.

Limitation of liability

To the maximum extent permitted by law, Motivated and Moving, LLC is not liable for any indirect, incidental, or consequential damages arising from use of this website. Nothing in these Terms limits liability that cannot be limited under applicable law.

Changes to these terms

We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
